1. Introduction
Welcome to The Colour Boutique.
These Terms & Conditions govern your use of The Colour Boutique website and the purchase and booking of personal colour analysis services offered by The Colour Boutique Pty Ltd (The Colour Boutique, we, us or our).
By using our website, purchasing a service or making a booking, you agree to the terms applicable to that activity. If you do not agree with these terms, please do not use the relevant website features or purchase our services.
These terms should be read together with our Refunds, Cancellations & Rescheduling Policy and Privacy Policy, which are available on our website.
Nothing in these terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable legislation.
2. Our services
The Colour Boutique provides personal colour analysis services, including in-person assessments, online assessments and group sessions or workshops where offered.
The services available, their inclusions, prices and booking arrangements will be described on our website or in the relevant written quote or booking confirmation.
Services may include personalised colour recommendations, physical or digital colour reference materials, written assessment information and follow-up consultations, depending on the service purchased.
We may update our service offerings from time to time. Changes to future offerings will not remove any rights you have in relation to a service already purchased.
3. Pricing and payment
Prices are displayed in Australian dollars unless otherwise stated.
The applicable price and service inclusions will be confirmed before you complete your purchase or booking.
Payment must be made using the payment methods made available at checkout or otherwise agreed with The Colour Boutique.
For individual appointments, payment requirements will be stated at the time of purchase or booking.
For appointments at a client's premises, all agreed travel fees and other additional costs must be paid in full before the appointment. We reserve the right not to attend or commence the session if these amounts have not been paid.
For group sessions and workshops, full payment for the agreed number of attendees is required in advance by the due date specified in the booking confirmation or invoice, unless otherwise agreed in writing.
We may use third-party payment providers to process transactions. Their own terms and privacy policies may also apply.
You are responsible for providing accurate information when making a purchase or booking.
4. Purchasing a session and booking later
You may be able to purchase a colour analysis session without selecting an appointment time immediately.
Where this option is available, you can arrange your appointment at a later date, subject to availability.
Unless otherwise agreed in writing or required by law, purchased sessions must be booked and used within 12 months of the purchase date.
Purchasing a session does not guarantee availability at a particular date or time. We recommend arranging your appointment as early as possible.
5. Individual appointments: cancellations and rescheduling
We understand that circumstances can change. Our standard requirements for individual appointments are:
At least 24 hours' notice is required to reschedule an appointment.
One reschedule is permitted without penalty, subject to availability.
Additional rescheduling requests will be considered at our discretion.
Requests made with less than 24 hours' notice may be treated as late cancellations, and the session may be forfeited.
Failure to attend without prior notice may be treated as a no-show, and the session may be forfeited.
Please arrive on time. Late arrival may result in a shortened session or, where we are unable to proceed, treatment of the appointment as a missed session.
Any forfeiture or cancellation charge will be subject to applicable law and your rights under the Australian Consumer Law.
Full details are set out in our Refunds, Cancellations & Rescheduling Policy, which forms part of the terms applying to our services.
6. Online colour analysis
Online colour analysis is a personalised service based on the photographs and information supplied by the client.
Photo submission
Clients must provide the required photographs and information by email within 60 days of purchase, following our photo guidelines.
If photographs are unsuitable for assessment, we may request additional or replacement photographs before proceeding.
If the required information is not received within 60 days, we may contact you to arrange a suitable timeframe. If you remain unresponsive, the booking may expire, subject to any rights you may have under applicable law.
Commencement and delivery
Work will commence once we have received the required photographs and information and confirmed that they are suitable for analysis.
The completed analysis and accompanying materials will be delivered electronically.
Your purchase includes a 30-minute Zoom follow-up session, which must be booked and used within three months of delivery of the completed analysis, unless otherwise agreed in writing or required by law.
You are responsible for providing a valid email address and arranging the follow-up appointment within this period.
Online assessments depend on the quality and suitability of the photographs supplied. We may request new photographs if the originals do not allow a reasonable assessment.
Our use, storage and retention of photographs are explained in our Privacy Policy.
7. Appointments at a client's premises
Where a session is arranged at your home or another agreed location, you must ensure that the premises are safe, accessible and suitable for the session.
Any travel fees and other additional costs will be agreed with you before the booking is finalised and must be paid in full before the appointment.
Please advise us in advance of access restrictions, parking requirements or other circumstances that may affect our ability to attend.
If the location is unsafe, inaccessible or unsuitable, we may need to pause, relocate or reschedule the session. We will discuss reasonable alternatives with you, taking account of the circumstances and any applicable legal obligations.
If we need to cancel or reschedule because of illness, severe weather, travel disruption or other unforeseen circumstances, we will contact you as soon as reasonably possible to arrange an alternative appointment or another appropriate solution.
8. Group sessions and workshops
Group bookings are arranged according to the agreed attendee numbers, session duration, location, inclusions and any specific requirements confirmed with the organiser.
Payment and attendee numbers
The organiser is responsible for confirming the number of attendees and coordinating arrangements with participants.
Full payment for the agreed number of attendees must be made in advance by the due date specified in the booking confirmation or invoice.
Requests to reduce the confirmed number of attendees must be made at least seven days before the scheduled session. After that deadline, the agreed booking fee remains payable, and individual non-attendance does not entitle the organiser to a refund, subject to applicable law.
Additional attendees require our prior approval and may incur an additional fee.
Group cancellations and rescheduling
Requests to cancel or reschedule a group booking must be made at least seven days before the scheduled session.
One reschedule may be permitted, subject to availability and agreement with The Colour Boutique. Requests made with less than seven days' notice will be considered at our discretion.
Specific arrangements for corporate events, larger workshops or customised group sessions may be agreed in writing. Where agreed in writing, those specific arrangements will apply to the extent they are consistent with applicable law.
If we need to cancel or reschedule a group session, we will contact the organiser as soon as reasonably possible to arrange an alternative date or another appropriate solution.
Further details are provided in our Refunds, Cancellations & Rescheduling Policy.
9. Nature of colour analysis services
Personal colour analysis is a professional assessment intended to help clients understand colours that may complement their individual colouring and inform personal styling and wardrobe choices.
Recommendations are based on the assessment conducted and the information available at the time.
Individual perceptions, preferences, lighting conditions, screen settings, fabric characteristics and other factors can affect how colours appear. Digital representations of colours may differ from physical fabrics and printed materials.
Our recommendations are intended as guidance rather than a guarantee of particular results, reactions from others, shopping outcomes or personal preferences.
Nothing in this section limits our obligation to provide services with due care and skill or any other consumer guarantee that applies under Australian law.
10. Intellectual property
Unless otherwise stated, the intellectual property rights in our website and its content belong to The Colour Boutique Pty Ltd or our relevant licensors.
This includes our branding, logos, website text, photographs, graphics, educational materials, colour analysis guides, workshop materials, assessment documents and other original content.
You may access and use our website for personal, non-commercial purposes.
You must not, without our prior written permission:
Copy, reproduce or republish our content for commercial use.
Sell, distribute, sublicense or commercially exploit our materials.
Reproduce or distribute our personalised assessment documents, guides or workshop materials to others.
Use our branding, logo or original content in a way that suggests endorsement, affiliation or ownership.
Remove copyright notices or other ownership information from our materials.
You may use your personal colour analysis results for your own personal purposes.
These terms do not transfer ownership of our intellectual property to you. Nothing in this section affects rights you may have under applicable law.
11. Photographs, privacy and marketing consent
We handle personal information in accordance with our Privacy Policy.
Photographs supplied for online colour analysis are used to provide the purchased service and for related purposes explained in that policy.
Photographs or videos taken during in-person sessions will not be used for marketing purposes without separate, explicit permission from the client.
Consent to marketing use is optional and is not a condition of purchasing or receiving a colour analysis service.
Where permission is given, the permitted use will depend on the scope of the consent provided. You may withdraw consent for future marketing use by contacting us, subject to the practical limitations described in our Privacy Policy.
Please refer to our Privacy Policy for details of how personal information is collected, used, stored, disclosed and retained, and how to make a privacy enquiry or complaint.
12. Cookies and website functionality
Our website may use cookies and similar technologies to support website functionality, security, analytics and other purposes, depending on the tools and settings in use.
Where required, we will seek consent for non-essential cookies or similar technologies. You may also manage cookies through your browser settings.
Some website features or third-party integrations may not function correctly if certain cookies are disabled.
Further information about the personal information collected through our website is provided in our Privacy Policy.
13. Third-party websites and services
Our website may contain links to third-party websites or use external services for payments, bookings, email communications, video conferencing or other functions.
We do not control the independent content, security or privacy practices of external websites and services. Their own terms and privacy policies may apply.
We take reasonable care in selecting services used in our business, but a link or integration does not necessarily imply endorsement of the third party or guarantee its availability.
You should review the applicable terms and privacy policies before using an external service.
14. Website information and availability
We aim to ensure that the information on our website is accurate and current. However, information may occasionally contain errors, omissions or outdated details.
We may correct or update website content from time to time.
We do not guarantee that our website will always be available, uninterrupted or free from technical errors. We may temporarily suspend or modify website features for maintenance, security or operational reasons.
Nothing in this section excludes any rights or remedies available to you under applicable law.
15. Limitation of liability
To the maximum extent permitted by law, we are not responsible for loss or damage arising from your use of our website where that loss or damage is caused by circumstances outside our reasonable control.
We do not exclude or limit liability where doing so would be unlawful, including liability that cannot be excluded under the Australian Consumer Law.
Where permitted by law, we will not be liable for indirect or consequential loss that was not reasonably foreseeable in the circumstances.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
16. Changes to these Terms & Conditions
We may update these Terms & Conditions from time to time to reflect changes to our business, services, website or legal obligations.
The current version will be published on our website with its latest update date.
Changes will apply from the date they are published, unless otherwise stated or required by law. Changes will not retrospectively remove rights that have already accrued or override terms that apply to an existing purchase where this would be unlawful.
We encourage you to review these terms periodically.
17. Governing law
These Terms & Conditions are governed by the laws of Queensland, Australia, and the applicable laws of the Commonwealth of Australia.
Any disputes will be dealt with by the courts or tribunals with appropriate jurisdiction, subject to any rights you may have under applicable consumer protection laws.
